2. Purpose and scope
This legal notice governs access to, browsing of and use of the Website, without prejudice to the possibility that the Owner may establish particular terms for specific services, which shall prevail over these general terms wherever they conflict with them.
This legal notice refers solely to the Website and its own contents, and does not apply to third-party websites that may be accessed through links.
3. User status and acceptance
Accessing and using the Website confers the status of user (hereinafter, "the User") and implies full and unreserved acceptance of every provision included in this legal notice, in the version published at the time of access.
If the User does not agree with these terms, they must refrain from using the Website.
4. Informative and free nature of the Website
The Website is merely informative in nature and serves to publicise the Owner's activity, products and services. Access is free of charge and requires no prior registration, user account or subscription.
The Website does not include an online shop, payment gateway, data collection forms, private area or booking system. Any contact with the Owner takes place through the channels indicated in section 1 (email or telephone), at the User's own initiative.
The information on products and services published on the Website is provided for guidance only and does not constitute a binding offer or a quotation. The terms of each engagement will be agreed, where applicable, individually between the Owner and the client.
5. Proper use of the Website
The User undertakes to use the Website and its contents in accordance with the law, this legal notice, good faith and public order. In particular, the User agrees to refrain from:
a) Using the Website for unlawful purposes, for purposes harmful to the rights of third parties, or for purposes that may damage, disable, overload or impair the Website or prevent its normal use.
b) Introducing or spreading computer viruses or any other physical or logical systems capable of causing damage to the systems of the Owner or of third parties.
c) Attempting to access restricted areas or the information systems of the Owner or its suppliers, or to circumvent the Website's security measures.
d) Using automated systems for bulk content extraction (scraping, unauthorised crawling or equivalent techniques) that exceed reasonable use or that may affect the performance of the Website.
e) Removing, altering or manipulating the contents, copyright notices or any other details identifying the rights of the Owner or of third parties.
The User shall be liable for damages of any kind that the Owner may suffer as a result of a breach of these obligations.
6. Intellectual and industrial property
All the contents of the Website — by way of illustration and not limitation: the graphic design, the navigation structure, the source code, the texts, the photographs, the illustrations, the graphics, the logos and the designs of the lighting products shown — are the property of the Owner or of third parties who have authorised their use, and are protected by Spanish and European legislation on intellectual and industrial property.
The trading names, trade marks and distinctive signs appearing on the Website belong to the Owner or to their legitimate proprietors, and access to the Website may not be construed as an assignment or licence of any right over them.
The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the contents of the Website without the prior written authorisation of the Owner is prohibited. Only the viewing and temporary downloading of the contents onto the User's device for personal and private use, without commercial purposes, is permitted.
The Owner reserves the right to take such legal action as may be available against anyone who infringes these rights.
7. Links
Outbound links. The Website may contain links to third-party pages (for example, a link to a map service to locate the Owner's premises). These links are provided solely to give information to the User, and following them means leaving the Website. The Owner does not manage or control those sites, accepts no liability whatsoever for their contents, services, privacy policies or availability, and recommends that the User review their terms before using them.
Inbound links. The establishment of links to the Website from third-party pages does not authorise the reproduction of its contents, does not imply any relationship, sponsorship, collaboration or supervision whatsoever on the part of the Owner, and must in all cases respect the Owner's image and rights. The technique of framing, or any other technique that misleads as to the origin of the contents, is prohibited.
8. Disclaimer of warranties and liability
The Owner endeavours to ensure that the information published on the Website is accurate and up to date, but cannot guarantee the absence of errors, omissions or outdated information, nor that the contents will satisfy the User's specific expectations or needs.
To the extent permitted by applicable law, the Owner accepts no liability for:
a) Damage arising from the use of the Website or of the information contained in it.
b) Interruptions, delays, errors or failures in accessing the Website, or the presence of viruses or harmful elements introduced by third parties beyond the Owner's control.
c) The contents and services of third-party sites linked from the Website.
Nothing in this section limits or excludes the Owner's liability in those cases where such limitation is not permissible under applicable mandatory law, in particular towards consumers and users.
9. Availability and continuity of the service
The Owner does not guarantee the uninterrupted availability and continuity of the Website, and reserves the right to suspend, interrupt or cancel its operation, temporarily or permanently, and to modify its presentation, configuration and contents, without prior notice and without this giving rise to any right to compensation.
10. Protection of personal data
The Website does not collect the User's personal data through forms and does not require registration. The processing of the personal data that the User voluntarily provides when contacting the Owner is governed by the Privacy policy, which forms an integral part of this legal notice.
11. Cookies
The Website does not use analytics, advertising or tracking cookies, whether first-party or third-party. Details are available in the Cookie policy.
12. Communications
For the purposes of this legal notice, and for any communication with the Owner, the User may write to the email address [email protected] or to the registered address indicated in section 1.
The User accepts email as a valid means for communications relating to the use of the Website, where they have previously provided an address for that purpose.
13. Amendment of the legal notice
The Owner reserves the right to amend the content of this legal notice unilaterally and at any time, as well as the presentation and configuration of the Website. Amendments take effect upon their publication on the Website. The User is advised to consult this page periodically.
14. Severability
If any clause of this legal notice is declared void or ineffective, in whole or in part, by a competent authority or court, such invalidity shall affect only that provision or the part of it found to be void or ineffective, and the remainder of the legal notice shall continue in force in all other respects.
15. Governing law and jurisdiction
These terms are governed by Spanish law.
Where the User acts as a consumer, the mandatory venue rules provided for in consumer and user protection legislation and in procedural law shall apply, and nothing in this legal notice restricts the rights to which the User is entitled.
In all other cases, the parties expressly submit, waiving any other venue to which they might be entitled, to the Courts and Tribunals of Palma de Mallorca (Illes Balears, Spain) for the resolution of any dispute arising from access to or use of the Website.
